1. Acceptance of Terms

By accessing or using the website of Sneha Enterprises, submitting an inquiry, or entering into any trade transaction with us, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, please do not use our website or engage in business with us. These terms apply to all visitors, buyers, importers and business partners.

 These Terms & Conditions constitute a legally binding agreement between you and Sneha Enterprises for all trade transactions.

2. About Sneha Enterprises

Sneha Enterprises is a registered export-import company headquartered in Patna, Bihar, India. We hold the following registrations:

  • IEC Code — Import Export Code issued by DGFT, Ministry of Commerce & Industry
  • GST Registration — All exports are zero-rated under Indian GST laws
  • FSSAI License — Food Safety & Standards Authority of India
  • APEDA Registration — Agricultural & Processed Food Products Export Development Authority
  • Phytosanitary Compliance — Plant quarantine certification issued per shipment by NPPO India

All export activities are conducted in full compliance with India's Foreign Trade Policy and applicable international trade regulations.

3. Products & Quality

All products listed on our website — grains, spices, fox nuts and fresh vegetables — are subject to the following:

  • Product specifications (moisture, purity, grade) shown on our website are indicative. Final confirmed specifications are stated in the Proforma Invoice.
  • Quality is tested by our in-house team and/or accredited third-party laboratories before shipment. Lab reports are available on request.
  • Natural agricultural products may have minor seasonal variations in colour, size or appearance — this does not constitute a quality defect.
  • We reserve the right to substitute a product variety with an equivalent quality product if a specific variety is unavailable, with prior buyer approval.
 Quality Assurance: Certificate of Analysis (COA) covering moisture, purity and pesticide residue is available for every shipment upon request.

4. Orders & Payment

All orders are governed by the following payment terms unless otherwise agreed in writing:

  • Confirmation: All orders are confirmed via a signed Proforma Invoice (PI) from both parties.
  • Advance Payment: A minimum 30–50% advance is required before procurement or production begins.
  • Accepted Methods: TT (Telegraphic Transfer / Wire Transfer), Letter of Credit (LC Sight / Usance), DP (Documents against Payment), DA (Documents against Acceptance).
  • Currency: All transactions are denominated in USD unless otherwise agreed in writing.
  • Validity: All price quotations are valid for 7 days from the date of issue. Market price fluctuations may require revision after this period.
  • Import Duties: All import duties, customs clearance charges and local taxes at the destination are the buyer's sole responsibility.
 Payment Safety: Sneha Enterprises only accepts payment to our official registered business bank account as stated in the Proforma Invoice. We never request payment to personal accounts.

5. Shipping & Delivery

  • Incoterms: All shipments are made under mutually agreed international Incoterms — FOB, CIF, CFR, EXW or DDP — as specified in the Proforma Invoice.
  • Transit Times: Estimated delivery times are indicative only. Delays caused by port congestion, shipping line schedules, weather or customs are beyond our control.
  • Export Documents: All standard documents — Commercial Invoice, Packing List, Bill of Lading, Certificate of Origin, Phytosanitary Certificate and Quality Certificate — are provided within 3–7 business days of vessel departure.
  • Marine Insurance: Insurance is included under CIF/CIP terms. Under FOB/CFR, the buyer is responsible for arranging cargo insurance.
  • Risk Transfer: Risk passes to the buyer in accordance with the agreed Incoterm at the point of delivery as defined under ICC rules.

6. Cancellations & Returns

Due to the perishable and commodity nature of agricultural products:

  • Orders cannot be cancelled once procurement/production has commenced after receipt of advance payment.
  • Quality claims must be raised within 7 calendar days of cargo arrival at the destination port, supported by a recognised third-party inspection report (SGS, Bureau Veritas, Intertek or equivalent).
  • Return of agricultural commodities after port delivery is generally not accepted.
  • In cases of proven quality non-conformity against agreed specifications, Sneha Enterprises will offer — at our discretion — replacement in the next shipment, a credit note, or partial refund.
 We are committed to resolving genuine disputes fairly and promptly. Please contact us within 7 days at exports@snehaenterprises.in with supporting documents.

7. Intellectual Property

All content on this website — including the Sneha Enterprises logo, brand name, product descriptions, photography, text, layout and design — is the exclusive intellectual property of Sneha Enterprises.

  • No content may be reproduced, copied, distributed or commercially used without prior written permission.
  • Unauthorised use of our brand name, logo or visual identity constitutes trademark infringement under Indian and international IP law.
  • Product images on this website are for representation purposes only and may not be used for any commercial purpose.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Sneha Enterprises shall not be held liable for:

  • Shipping delays caused by carriers, port authorities, customs departments or force majeure events including floods, droughts, earthquakes, strikes, wars, pandemics or government-imposed restrictions.
  • Indirect, incidental, special or consequential losses or damages arising from the use of our products.
  • Losses resulting from incorrect or incomplete information provided by the buyer in their purchase order or inquiry.
  • Content or policies of any third-party websites linked from our website.
  • Natural quality variations inherent to agricultural commodities.

Our total maximum liability in any single transaction shall not exceed the invoice value of the shipment in dispute.

9. Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of India.

  • Step 1 — Negotiation: Both parties shall first attempt to resolve any dispute through good-faith mutual negotiation within 30 days.
  • Step 2 — Arbitration: If unresolved, disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996 of India, with the seat of arbitration in Patna, Bihar.
  • Jurisdiction: The courts of Patna, Bihar, India shall have exclusive jurisdiction over any legal proceedings.
 International Buyers: Disputes may alternatively be resolved under ICC International Arbitration Rules if agreed upon in the sales contract at the time of order confirmation.
